Below are our client and student privacy policy and our website private policy.

CLIENT AND STUDENT PRIVACY NOTICE

We are dedicated to safeguarding and preserving your privacy. This privacy notice explains what happens to any personal information that you provide to us, or that we collect from you, in connection with you booking or course or undertaking coaching.

We may update this notice from time to time and will provide you with an updated copy if we do.

This privacy notice applies to you if:

you have booked a course with us on your own behalf;

you have booked a course with us on behalf of someone else (for example, a relative or employee); or

you have been booked onto a course with us by someone else (for example, a relative or your employer).

In this privacy notice, any reference to you applies whichever of the categories above you fall into. Any reference to the client applies to you only if you were the person who booked the course, and any reference to the student applies to you only if you are the person attending the course.

1     PERSONAL INFORMATION

1.1 When you book a course, you will be asked for certain personal information. This falls into two categories:

1.1.1 personal information about the client, such as the client’s name, address and payment details; and

1.1.2 personal information about the student, such as the student’s name, date of birth, telephone numbers (including mobile number) and email address.

1.2 In addition to the personal information that we ask for at the time of booking, we may also ask for (or be provided with) further personal information about either the client or the student, either prior to the booking being placed, at the time it is placed, or subsequently. This may include for example information about the student’s employment and/or educational history and may include sensitive personal data such as details about fitness or health issues that the student may have which could affect his or her ability to participate in the course.

1.3 If you are booking a course on behalf of another person, you must obtain that person’s consent prior to providing his or her personal information to us, and by submitting this information to us you are confirming that you have done so.

1.4 If you have been booked on a course by another person on your behalf, that person will have provided us with personal information about you when they placed the booking. However, even though they placed the booking and our agreement is with them, we have legal obligations to you in respect of how we use your personal information and you should therefore still read this privacy notice yourself and let us know if you have any questions.

1.5 We are committed to protecting your privacy and will only use personal information in accordance with applicable data protection legislation, including the Data Protection Act 1998 and (once applicable) the General Data Protection Regulation.

1.6 The information that we request from you is information that we consider necessary or desirable so that we handle any booking made by a client and provide the course to the student.

1.7 If you do not agree to us holding any particular piece of personal information about you, please do submit it to us (if someone else is booking the course on your behalf, please ask them not to submit it to us). Please note however that, depending on the significance of the personal information withheld, this may adversely affect our ability to provide the course, or even mean that we cannot provide the course at all.

1.8 You are entitled by law to ask for a copy of your personal information or to correct or update your personal information at any time. Please contact us using the details in paragraph 7.

2     USES MADE OF THE INFORMATION

2.1 We (and our representatives) may use your personal information for the purposes of:

2.1.1 processing your booking, including sending the course confirmation letter, course materials and any other course related documentation to you;

2.1.2 assessing the eligibility of the student to attend the selected course;

2.1.3 delivering the course to the student;

2.1.4 processing payment, sending out bills and pursuing any outstanding payments;

2.1.5 where you have consented to be contacted for such a purpose, providing you with information about products and/or services that we feel may interest you, or undertaking surveys or market research;

2.1.6 notifying you about any issues or changes relating to the course; and

2.1.7 providing the client with contractual notices.

2.2 If you do not want us to contact you in the way set out at paragraph 2.1.5 you can “opt out” by contacting us as described in paragraph 6.

2.3 By booking a course with us, you consent to us using your personal information in the way described in this privacy notice and, if you are booking on behalf of someone else, you confirm that the person you are booking on behalf of has consented to their personal information being used in the way described in this privacy notice.

2.4 You have the right to withdraw your consent to our processing of your personal information at any time, which you may do by contacting us as described in paragraph 7. Please note however that the withdrawal of your consent will not affect any use of the personal information made before you withdrew your consent.

3 DISCLOSURE OF YOUR INFORMATION

You consent to us (and our representatives) disclosing your personal information to third parties:

3.1 in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;

3.2 if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply such other terms as apply to our relationship, or to protect the rights, property, or safety of our clients, ourselves or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction; and

3.3 if we determine that such disclosure is necessary in connection with any investigation or complaint regarding the booking, including regarding the student’s conduct whilst attending the course.

4 RETENTION, UPDATING AND REMOVAL OF YOUR PERSONAL INFORMATION

4.1 Where you provide us with personal information, we may retain this information for future use, including:

4.1.1 for delivering the course to the student;

4.1.2 for record keeping purposes;

4.1.3 for sending you information about products and/or services that we feel may interest you, or undertaking surveys or market research, if you have consented to this; and/or

4.1.4 for exercising our rights.

4.2 The duration for which we retain your personal information will differ depending on the type of information and the reason why it was submitted. However, in some cases personal information may be retained on a long-term basis: for example, personal information that we need to retain for legal purposes will normally be retained for at least six years in accordance with usual commercial practice and regulatory requirements.

4.3 You are responsible for ensuring that the personal information that we hold about you is accurate and up-to-date, and you should check it on a regular basis. If you need us to change any of the information, we hold about you please contact us using the details in paragraph 7 and, where appropriate, we will update the relevant personal information for you.

4.4 You may in certain circumstances be entitled to request us to delete personal information that we hold on you. To make a request of this nature, please contact us, providing full details of the personal information you want to be erased and the reason(s) for your request. We will consider all requests upon receipt and confirm to you whether we are able to agree to your request.

4.5 Please be aware that deleting personal information that we hold about you may affect our ability to provide the course to the student.

4.6 We may transfer personal information that we collect from you to locations which are outside the European Economic Area (EEA) for processing and storing, including by staff operating outside the EEA who work for us or for one of our suppliers. The countries that your personal information is transferred to may offer less protection for personal information than is offered by countries within the EEA. By submitting your personal information to us, you agree to us transferred your personal information in this manner.

5 ISSUES AND COMPLAINTS

5.1 In the unlikely event that you have any concerns about how your personal information is being used, please contact us as described in paragraph 6. This includes situations where you want to request the rectification or erasure of your personal information, restrictions to be placed around how we use your personal information, or to object to a particular use.

5.2 If you make a complaint about our handling of your personal information, it will be dealt with in accordance with our complaints handling procedure. In the first instance we will review your complaint and respond to you within 28 days. If you are dissatisfied with this response you may request that your complaint be escalated, in which case it will be passed to a senior person in our business who will review your complaint and the initial response and provide a further response within 28 days of your request to escalate the matter.

2.1.1 processing your booking, including authorising payments and/or sending a bill to you and providing the course, as described in more detail in our privacy notice referred to above;

2.1.2 ensuring that our Website is presented in the most effective manner for you and your computer;

2.1.3 where you have consented to be contacted for such a purpose, providing you with information about products and/or services that we feel may interest you, or undertaking surveys or market research;

2.1.4 notifying you about a change to our Website or services; and

2.1.5 record-keeping and tracking your use of the Website through use of cookies and log files (see paragraphs 6 and 7 below).

2.2 If you do not want us to contact you in the way set out at paragraph 2.1.3 you can “opt out” by indicating this when submitting email forms on the Website or by contacting us as described in paragraph 11.

7.1 In common with most websites, our Website logs various information about visitors, including internet protocol (IP) addresses, browser type, internet service provider (ISP) information, referring / exit pages and date / time stamp.

7.2 We may use this information to analyse trends, administer the Website, track your movement around the Website and gather broad demographic information. However, we do not link this information to personally identifiable information.
